Terms of Service and Usage Policy
Effective October 26, 2026 · Private beta
1. Who operates FieldClimb
FieldClimb is currently operated by Zach Barbre and Kevin Aalders, referred to in these terms as FieldClimb, we, us or our. FieldClimb is a product name; these terms do not represent that a corporation or limited liability company has already been formed. Questions may be sent to kevin@fieldclimb.com.
These terms govern your use of FieldClimb, including its beta features, Gage, calculations, imports, reports and Buddies. The Privacy Policy and AI Notice explain information handling and AI processing. We will update the operator information and provide notice if the service moves to a formed legal entity.
2. Eligibility and acceptance
You must be at least 18 years old and legally able to enter this agreement. Use your own authorized account, provide accurate account information and protect your sign-in credentials. Beta access is by invitation; accepting these terms does not itself grant an invitation or company permissions.
Checking the acceptance box and continuing records your agreement to this version. You may read the linked documents before deciding. Acceptance is recorded to your account with the version, document fingerprint and time. A material update may require a new acceptance; routine sign-ins do not.
3. Employer policies and authority to use information
Before using FieldClimb for work, check with your employer or other relevant organization to confirm that your use follows its technology, confidentiality, customer-data, AI, recordkeeping and compensation policies. Obtain any required authorization before uploading or sharing employer, customer or third-party information. If permission is unclear, do not enter that information until you have clarified it.
You are responsible for the information you enter, the permissions needed to use it, your sharing choices and your decisions based on it. FieldClimb does not approve your use on behalf of your employer, change your employment agreement or bind an employer to a compensation calculation.
4. Records, estimates and professional judgment
FieldClimb is an organizational and decision-support tool. Calculated commissions, expected pay, imports, matching suggestions, reports, goals and AI outputs may be incomplete, delayed or incorrect. Confirm important amounts, dates, matches and changes against original documents, actual payroll, employer records and applicable agreements before relying on them.
FieldClimb is not an employer payroll system, a guarantee of payment, or a substitute for qualified accounting, legal, engineering, safety or other professional advice. Field use, installation decisions and compliance with codes or safety procedures remain your responsibility and that of the responsible qualified professionals. Keep official records required by your employer or by law.
5. AI and external providers
Using Gage or another AI feature sends the content and relevant authorized records needed for that request to OpenAI. This may include customer or financial information you supply. AI can misunderstand instructions, invent information or make errors. Review drafts, extracted payroll, summaries and proposed actions before saving or confirming them. Manual entry remains available.
Hosting, database, authentication, email, push and GIF providers process information needed for their features. GIPHY searches send your search terms and ordinary network or device information to GIPHY; GIF images load from its services. Their availability, processing and policies are outside our complete control. The Privacy Policy and AI Notice give further details.
6. Backups, access and service interruptions
Keep independent, current local copies of important records and original source documents. Use available exports and verify that the copies contain what you need and can be opened. FieldClimb should not be your only copy of information you cannot afford to lose. Request help if an export you need is unavailable.
We use access controls, service-provider infrastructure, database recovery facilities and change verification to help preserve safety and integrity. These measures reduce risk; they do not guarantee uninterrupted access, perfect security, recovery of every record or a recovery time. Backups are not a substitute for your own independent copies.
Beta features may change or be unavailable. Outages, maintenance, software errors, device or network failures, provider changes, account restrictions or service discontinuation may delay access or cause lost or corrupted information. Where reasonably practicable, we aim to provide notice of planned material discontinuation and an opportunity to request available exports. Security or legal needs may require earlier restrictions.
7. Usage policy and content
You retain the rights you have in your content. You authorize FieldClimb and its providers to host, process, transmit and display that content as needed to provide, protect and support the features you use and the recipients you choose. You must have the necessary rights to upload or share files, photos, memes and other content.
Do not use FieldClimb to break the law, violate employer confidentiality or another person’s rights, harass or threaten others, send unlawful or abusive content, upload malware, bypass access controls, impersonate someone, or manipulate records or rankings fraudulently. Do not place passwords, payment-card credentials, government identification numbers or unnecessary sensitive information in notes, chat, files or AI requests.
Buddy sharing and notification preferences are separate from this agreement. Review them before using social features. Removing or blocking a connection cannot recall information or screenshots already received. Report misuse or a suspected security issue to kevin@fieldclimb.com.
8. Service limitations and responsibility
To the extent permitted by applicable law, the beta service is provided as is and as available, without a promise that it will be error-free, continuously available, suitable for every business purpose or able to restore every item of data.
To the extent permitted by applicable law, FieldClimb and its operators, and where applicable its officers, employees, contractors and authorized representatives, are not responsible for losses caused by your unauthorized or unlawful use, lack of required employer or third-party permission, inaccurate inputs, or reliance on unverified estimates or AI results. To that same extent, liability for indirect or consequential losses, including lost profits, business opportunities or data arising from interruptions or inability to use the service, is excluded.
These limitations do not waive rights that cannot lawfully be waived or exclude responsibility where exclusion is prohibited, including for fraud, willful misconduct or other conduct that applicable law does not permit us to disclaim. They do not remove our applicable privacy, security or consumer-protection obligations. Responsibility for a particular incident depends on its facts and the law that applies.
9. Access changes, fees and updated terms
We may restrict access or remove content when reasonably necessary to address misuse, protect people or systems, or comply with law. You may stop using FieldClimb and request available account-data assistance. Stopping use does not automatically erase financial, security, consent or audit records.
This agreement does not authorize a charge. Any paid offering requires its own disclosed price and authorization. Existing beta-access arrangements remain subject to their stated terms and continued operation of the service.
We will date and version updates and provide notice of material changes. Where new agreement is needed, we will ask before treating you as having accepted the new version. If a provision is unenforceable, the remaining provisions continue to the extent allowed by law. No provision overrides mandatory rights that apply to you.
